Items for sale on madeinmodenatravel.com (hereafter the “Store”) are sold and invoiced by Mimo srl.
ACCEPTANCE OF THE GENERAL CONDITIONS OF SALE AND CONCLUSION OF THE CONTRACT
1.1 The contract between Mimo Srl and the Customer is concluded with the acceptance, even partial, of the order by Mimo. In case of non-acceptance of the order, Mimo will still promptly inform the Customer.
1.2 By placing an order in the various ways provided, according to the order form on the Store (hereinafter referred to as “Order”), the Customer declares that he/she has read all the information provided to him/her during the purchase process and fully accepts these general conditions (hereinafter referred to as the “Conditions”).
1.3 These Conditions may be printed or saved in a durable medium, subject to the provisions of Art. 12 of Legislative Decree. 70/2003 and Art. 51 of Legislative Decree 206/2005, as amended by Legislative Decree 21/2014.
PURCHASE MODE
2.1 The items sold by Mimo are only those on the Mimo website at the time the Order is placed, as described in the related information sheets.
2.2 It is understood in any case that the images accompanying the description sheet of a product are only for information purposes and may not be perfectly representative of its characteristics, but differ In color and size (also because of the browser and monitor used to access the Store and view images).
2.3 In order to place an Order, the Customer must fill out the appropriate form on the Store and submit it after carefully reviewing the Conditions, as well as the characteristics of the product and/or items he/she intends to purchase. The Customer shall also request from Mimo, if desired, the issuance of a tax invoice relating to the purchase, pursuant to Art. 22 Presidential Decree no. 633/1972.
2.4 Correct receipt of the Order is confirmed by Mimo through an e-mail reply, sent to the e-mail address provided by the Customer. Such confirmation message will briefly summarize the conditions of purchase, as provided by the applicable regulations, as well as the data entered in the Order by the Customer, in order to verify it and, eventually, communicate the necessary corrections of incorrect data without delay.
PRICES AND PAYMENT METHODS
3.1 Prices shown on the website are inclusive of tax and VAT. Any shipping or payment charges are, however, communicated to the Customer in advance via the site or these Terms.
3.2 The following payment methods are provided:
(i) Credit Card, Debit Card or Prepaid Card on international banking circuits.
DELIVERY AND SHIPPING CHARGES
4.1 Items purchased by the Customer will be fulfilled within the next 48 hours of Mimo’s acceptance of the Order, at the cost specifically stated in the Store prior to placing the Order. Mimo reserves the right to accept or not accept deliveries requested outside Italian or European borders. In any case, for deliveries to be made outside Italian borders, shipping costs and delivery times may vary.
4.2 Regarding deliveries required to countries outside the European Union, any import customs charges will be borne by the recipient. Therefore, the Customer is urged to contact the customs authorities in his or her country in advance to check costs and any import restrictions;

4.3 The delivery times indicated by Mimo are to be understood as purely indicative and a delay with respect to the same, or any delivery made by successive split shipments shall not entitle the Customer to refuse the delivery itself and to the claim of indemnity or compensation.
4.4 Upon delivery of the items, the Customer is required to check:
That the number of packages being delivered corresponds to what is indicated in the transport document. That the packaging is intact, undamaged, wet or otherwise altered, including in the sealing materials (adhesive tape or metal strapping). Any damage to the packaging and/or the product or the mismatch of the number of packages or indications, must be immediately detected, with specific indication on the delivery document of the product to be returned to the courier. Any problems concerning the physical integrity, correspondence, or completeness of the items received must be reported within 7 days of delivery in the manner provided herein.
RIGHT OF WITHDRAWAL
5.1 The goods must be returned undamaged, complete with all its parts and in the original packaging (envelopes and packaging), stored and possibly used for the time strictly necessary to establish and verify the nature, characteristics and dimensions, according to normal diligence, without any signs of wear or dirt, in accordance with the following conditions: the right of withdrawal can apply to the product purchased in its entirety; in fact, it is not possible to exercise withdrawal only on part of the product purchased (eg: accessories, accessories, etc….); the right of withdrawal is excluded for items that can be customized and personalized or pre-order, since the withdrawal is possible, the product must be undamaged and returned in its original packaging, complete in all its parts (including packaging and any documentation and accessory equipment: labels , tags, tags, seals, etc. …); shipping costs (and customs charges, if any) for the return of the goods will be the sole responsibility of the customer. The shipment, until its receipt in the warehouse indicated by Mimo, is under the complete responsibility of the customer; in case of damage to the goods during transport, Mimo will inform the Customer, to enable him to promptly report his claim to the carrier of his choice and obtain a refund; the product will then be made available to the customer, canceling at the same time the request for withdrawal; Mimo will not respond in any way for damage, theft, loss occurred during or otherwise dependent on the shipment for return.
5.2 Mimo will refund the Customer the full amount already paid, less any additional shipping charges pursuant to Art. 56, para. 2, of Leg. n. 21/14) within 14 (fourteen) days after withdrawal, by reversal of the amount charged, using the same means of payment used by the Customer for the initial transaction, unless otherwise agreed. In any case, the Customer will not incur any costs as a consequence of such a refund. Mimo may suspend the refund until receipt of the returned item or until the Customer demonstrates that the item has been properly returned, whichever is earlier.
5.3 In any case, the Customer shall forfeit the right of withdrawal in cases where Mimo ascertains that: the returned goods and/or its accessories, and/or its packaging are not intact; the item is missing its outer packaging and/or its original inner packaging; the item is missing elements integral to the same and/or accessories (e.g. fasteners, laces, buckles, etc.). In case of forfeiture of the right of withdrawal, Mimo will return the purchased goods to the sender, charging the sender the shipping costs and, if already refunded, the price of the goods.
GUARANTEES
6.1 All items sold by Mimo are covered by the 12 (twelve) month warranty for conformity defects, pursuant to Title III of Legislative Decree. 206/2005. To take advantage of the warranty, the customer must keep the invoice, or payment receipt, along with the shipping document.
6.2 The warranty for conformity defects shall be enforced provided that the relevant item has been used properly, in accordance with its intended use and with the instructions for use and washing in and/or with the item.
6.3 In the event that, for any reason, Mimo is unable to provide the Customer with an item under warranty (repaired or replaced), or where repair or replacement would be, also due to the value of the item, excessively burdensome, Mimo may proceed to the reasonable reduction of the price paid, or to the refund of the full amount paid with the termination of the contract.
6.4 In cases where the application of guarantees provides for the return of the goods, the same must be returned by the customer in the original packaging, complete in all its parts (including packaging and any documentation and accessory equipment).

PRIVACY
8.1 Personal data collected by placing an Order will be processed by Mimo for the sole purpose of fulfilling the Customer’s express requests, in accordance with EU Regulation 2016/679 and the privacy policy on the website. Any further processing will be carried out only with the express consent of the Client.
APPLICABLE LAW
9.1 The contract of sale referred to in these Conditions and its execution and governed by Italian law, with the disregard of conflict rules and the United Nations Convention for the International Sale of Goods. The Court of the Customer’s municipality of residence shall have jurisdiction to resolve the relevant disputes.
RETURNS AND REFUNDS
You can return your purchase by writing to our Customer Service Department within 14 (fourteen) business days from the date you receive your package.
The merchandise must be returned intact, complete with all its parts and in its original packaging (envelopes and wrappings), stored and possibly used for the time strictly necessary to establish and verify its nature, characteristics and dimensions, according to due diligence, without signs of wear or dirt.
